Terms & Service Conditions (Draft)
Draft for qualified legal review. These terms are not approved as final legal terms and do not replace a project-specific agreement.
Draft date: 16 July 2026
These draft terms describe intended service conditions for Cowcy enquiries and projects. They remain subject to qualified Indian legal review.
Operator and service brand
Cowcy is a service brand operated by Sahotaz. Contact location: South Delhi, Delhi, India. Public contact: info@cowcy.com and +91 98105 58820.
Website purpose
The website presents frontend service information and accepts project enquiries. Website content is informational. Sending an enquiry does not create a client relationship or require project acceptance. A project begins only after written scope, commercial terms, and any required deposit are agreed.
Service scope
Frontend websites, e-commerce storefronts, and web app interfaces with selected platform and API integrations.
The current scope excludes custom backend infrastructure, custom databases, authentication servers, payment-processing infrastructure, tax, inventory, shipping or fulfilment engines, hosting operations and 24/7 monitoring unless separately agreed, and guaranteed ranking, traffic, conversion, sales, or business results.
Proposals and project agreements
Each project is governed by its approved proposal, scope, and written service agreement. Where those project documents differ from this general page, the project-specific agreement applies.
Proposals may define deliverables, exclusions, dependencies, timeline, review stages, revision allowance, payment schedule, support, handoff, ownership, and third-party costs.
Client responsibilities
- Provide an accurate brief and lawful content.
- Provide timely access and approvals.
- Confirm rights to supplied text, images, trademarks, and data.
- Handle credentials through an agreed secure channel.
- Do not send passwords or secrets through the public form.
- Review deliverables within agreed stages.
- Take responsibility for business, legal, tax, product, and regulatory claims supplied by the client.
Pricing and payment
Pricing is project-based and quote-only. Payment amounts, deposit, milestones, invoicing, taxes, and due dates are defined in the project agreement. No work is required to begin until any agreed commencement payment and required materials are received. This draft does not state a default deposit percentage, default late fee, or GST registration status.
Timelines
Estimates depend on scope, content readiness, integrations, access, approvals, and feedback. Dates become commitments only when confirmed in the project agreement. Client or third-party delays may affect the schedule. No guaranteed instant or fixed delivery period exists.
Revisions and changes
Included review and revision boundaries are defined per project. Changes to approved pages, flows, integrations, content volume, or responsibilities may be treated as scope changes. Scope changes may affect price and schedule. This draft does not create a default revision count.
Third-party services
Projects may involve commerce platforms, form providers, hosting, domain registrars, APIs, payment-enabled platforms, fonts, libraries, and other licensed components. Third-party availability, pricing, terms, privacy, and service continuity are controlled by those providers. Cowcy is not the provider of third-party infrastructure. Client approval may be required before third-party services are connected. No third-party provider is guaranteed permanently.
Intellectual property
Client-supplied materials remain the client's or licensor's property. Third-party and open-source components remain subject to their own licences. Pre-existing Cowcy tools, methods, reusable patterns, and general know-how remain with their existing owner. Ownership or licence of custom deliverables is defined in the project agreement and may depend on full payment. This draft does not state that all source code automatically transfers or that Cowcy owns client content.
Portfolio and publicity
Client work is published only when permission and project details are confirmed. Private or confidential work remains unpublished unless expressly approved. Concept work is labelled clearly. No implied portfolio permission arises merely from working together.
Confidentiality
Project confidentiality obligations should be documented in the project agreement or NDA. Public form and ordinary email should not be used for passwords, API keys, or highly sensitive information. This draft does not promise absolute confidentiality outside an agreed arrangement.
Acceptance and handoff
Review, acceptance, deployment, source delivery, documentation, training, and handoff are defined per project. Client acceptance does not remove separately agreed defect-fix obligations. This draft does not create an acceptance-by-silence period.
Support and maintenance
Post-launch support is a separate agreed scope unless expressly included. It may cover frontend fixes, content changes, dependency maintenance, or improvements. It does not imply 24/7 monitoring or unlimited support. Response targets and inclusions must be written in the support agreement.
Cancellation and pause
Cancellation, pause, refund, committed costs, completed work, and handoff are governed by the project agreement. Completed work and non-recoverable third-party costs may remain payable. This draft does not describe any payment as automatically non-refundable without legal review and agreement wording.
Warranties and results
Work is performed with reasonable professional care under the agreed scope. Compatibility targets are defined in the project agreement. No guarantee is made for search rankings, traffic, sales, uninterrupted third-party service, or business outcomes. This draft does not attempt to exclude non-excludable statutory rights.
Liability boundary
Liability allocation and any cap must be defined in the project agreement. Nothing on this page is intended to exclude liability that cannot lawfully be excluded. This section requires qualified legal review and does not invent a monetary liability cap.
Privacy
Direct contact and future form submissions are handled under the Privacy Policy. The Privacy Policy is currently a draft. Form submission remains disabled pending provider and legal approval.
Response commitment
I aim to provide an initial response to genuine project enquiries within 2 business days.
Business days are Monday through Friday, excluding public holidays observed in Delhi, India. This is an enquiry acknowledgement target, not a project-delivery guarantee. Spam, incomplete, abusive, or technically undeliverable messages may not receive a response.
Governing law and disputes
These general terms are intended to be governed by the laws of India. Courts of competent jurisdiction in Delhi, India are intended to have jurisdiction, subject to the final project agreement and qualified legal review. Parties should first try to resolve disputes through good-faith written communication. This draft does not claim exclusive jurisdiction as final approved wording.
